Terms and Conditions
1. Purpose
These Terms and Conditions (T&Cs) are intended to define the rights and obligations of XERAK and its customers in the context of product sales offered on the website xerak.com. Any order placed on the Website implies acceptance without reservation of these T&Cs.
2. Products
The products offered are described as accurately as possible. However, if errors or omissions occur, XERAK cannot be held liable.
3. Prices
Product prices are displayed in euros (€) and include all applicable taxes, excluding delivery charges. XERAK reserves the right to modify prices at any time. The price billed to the customer is the price displayed on the Website at the time of order confirmation.
4. Orders
An order is confirmed upon receipt of payment. XERAK reserves the right to cancel or refuse any order in case of a dispute with the customer or in case of non-payment.
5. Payment
Payment is due at the time of order. The customer can pay via PayPal. Transactions are secured through an online payment system that meets industry standards.
6. Delivery
Products are shipped to the delivery address provided by the customer at the time of order. XERAK agrees to dispatch orders within the timeframes indicated on the Website but cannot be held liable for delivery delays due to events beyond its control.
7. Right of Withdrawal
In accordance with applicable legal provisions, the customer has a period of 14 days from the date of receipt of the order to exercise their right of withdrawal without having to justify any reason or incur penalties. Returned products must be in their original condition and complete. Return shipping costs are the responsibility of the customer.
8. Warranty
Products are covered by the legal warranty of conformity and the warranty against hidden defects in accordance with legal provisions. In case of defect, the customer can contact our customer service to obtain a refund or exchange of the product.
9. Liability
XERAK shall not be held liable for indirect damages that may arise from purchasing the products. In any case, XERAK's liability is limited to the amount of the order.
10. Personal Data
Customer personal data is collected and processed in accordance with our Privacy Policy. This data is necessary for order processing and is not shared with third parties without the customer’s consent.
11. Disputes
These T&Cs are governed by the laws of France. In case of dispute, an amicable solution will be sought before any legal action. Failing that, the competent courts will be those of Paris.
12. Modification of the T&Cs
XERAK reserves the right to modify these T&Cs at any time. The applicable T&Cs are those in effect on the date the customer places the order.
